कानूनी ख़र्च न उठा पाने की वजह से असम के डिटेंशन कैंप में एक व्यक्ति की मौत

असम के तेज़पुर के एक डिटेंशन कैंप में 65 वर्षीय जब्बार अली की बीते गुरुवार रात को मृत्यु हो गयी। जब्बार अली को विदेशी घोषित कर डिटेंशन कैंप में भेज दिया गया था और ग़रीबी के कारण वे कानूनी लड़ाई लड़ने में भी असमर्थ थे। शुक्रवार को अली का शव उदलगुरी ज़िले में रह रहे उनके परिवार को सौंप दिया गया।

ग़ौरतलब है कि दर्रांग ज़िले में एक विदेशी ट्रिब्यूनल के निर्णय के अनुसार दो बच्चों के पिता अली को 2015 में विदेशी घोषित कर डिटेंशन कैंप में रखा गया था। गुवाहाटी उच्च न्यायालय ने भी उसी वर्ष इसकी समीक्षा के लिए दायर की गई याचिका को खारिज कर दिया था।

द टेलीग्राफ की एक रिपोर्ट के अनुसार अली दमा के मरीज़ थे। बुधवार को उनकी हालत बिगड़ने लगी, जिसके बाद जेल अधिकारियों ने उन्हें कनकलता सिविल अस्पताल में भर्ती करवा दिया, जहां उनकी एक दिन बाद मृत्यु हो गई।

अली के वकील, एम यू महमूद ने द टेलीग्राफ को बताया कि अली के पिता का नाम 1951 के राष्ट्रीय नागरिक पंजी (एनआरसी) और उसके बाद के सभी मतदाता सूचियों में होने के बावजूद उन्हें न्यायालय द्वारा विदेशी घोषित कर दिया गया था।

ऑल असम माइनॉरिटीज़ स्टूडेंट्स यूनियन के अध्यक्ष अज़िज़ुर रहमान ने कहा, “राज्य सरकार अली का शव उनके परिवार को सौंप कर मामले से अपने पल्ला झाड़ रही है। अगर सरकार इतने अच्छे से जानती कि अली धनश्री खुटी में रह रहे उस परिवार से ताल्लुक़ रखते हैं तो उन्हें डिटेंशन कैंप में रखा ही क्यों गया?”

रहमान ने यह भी बताया कि शुरुआत में धनश्री खुटी के लोग अली का जनाज़ा निकालना से इनकार कर रहे थे और उनकी मांग थी कि पहले पुलिस अधीक्षक और उदलगुरी के पुलिस उपायुक्त उनके गाँव में आकर घोषणा करें कि अली विदेशी नहीं थे। रहमान ने अपनी बात पर ज़ोर देते हुए कहा कि आख़िरकार जनाज़ा पुलिस के दबाव में आकर निकाला गया।

गुवाहाटी में रह रहे वकील अमन वदूद ने अपने ट्वीट के ज़रिये पूरे मामले को स्पष्ट किया और इस बात पर ज़ोर दिया कि, “एक बंदी के शव को अंत में परिवार वालों को सौंपना ही है, तो जिंदा रहते हुए क्यों नहीं??”

Police says he died a natural death. His body was handed over to his family in Udalguri district of Assam. If he was a “foreigner” why hand over his body to his Indian family?

Jabbar Ali was our client. We challenged the ex parte order in 2015 by which he was declared a foreigner. The Honble HC was pleased to dismiss the writ.

Earlier notice was served to him, he engaged a lawyer b4 Tribunal. But his acute poverty & illetracy came in his way to defend his citizenship. Finally the Tribunal declared him a foreigner in his absence. The 1951 NRC , 1965 voter list of his father remained just piece of paper

The Burden of Proof is on the accused u/s 9 of the Foreigners Act, 1946. This draconian provision is applied on the most poor and illiterate section of the society.

AND before accusing a person of being illegal immigrant there is NO investigation whatsoever.

SC has held that when the burden of proof is reversed, the investigation shud be free from apprehension of bias or unfairness

BUT here Indian citizens are randomly accused of being illegal immigrant in MOST unfair manner. Constitution has been reduced to a mere stack of papers

There are around 1,000 people detained in 6 detention centre across Assam. Many cases are dismissed by SC. They are under INDEFINITE detention as they are basically Indian citizens, declared a “foreigner” for clerical errors in papers. HENCE can never be deported to Bangladesh.

How many more Subrata and Jabbar will this nation allow to happen??

Before another Jabbar and Subrata happens, sincerely hope they are allowed to unite with their families.

Eventually if a dead body of a detainee is handed over to the family, WHY not when alive??
